How to Request Mediation
NOTICE: If there is a PFA Order in effect or a temporary or final PFA Order has been entered involving you and the other party within the past 24 months your case will not be accepted to the Mediation Program unless you first obtain a court order expressly allowing you and the other party to proceed to mediation despite the PFA.
If you would like to have your conflict mediated, please submit an application package, which includes the following items:
- Mediation Program Agreement + Additional Forms
- Either the Request for Mediation Form (in active litigation) or the Request for Mediation Form (not in active litigation);
- Payment for $1,000.00* by check made payable to: Montgomery Bar Association or click here to pay online by credit card.

*$1,000.00 fee includes up to three (3) hours of mediation. $200.00 is a non-refundable administrative fee and $800.00 represents payment for three (3) hours of the Mediator’s time. If mediation is cancelled/withdrawn prior to the assignment of a Mediator, the parties will receive a refund in the amount of $800.00. If mediation is cancelled/withdrawn after a Mediator has been assigned, the parties will receive a refund in the amount of $600.00. If mediation is cancelled/withdrawn within five (5) days of the scheduled mediation date, no refund will be provided. Additionally, if you would like to reserve space at the MBA to hold your mediation, an additional $150.00 - $200.00 (based on room requirements) for up to three (3) hours will be paid by the parties to the MBA prior to the first mediation session.
